Any such relationship must arise from a separately executed agreement or applicable law.

RENTAL AND LEASING INFORMATION

4. APARTMENT AVAILABILITY

Apartment availability displayed on the Website is subject to change without notice.

An apartment appearing as available on the Website may subsequently be:

• Rented;
• Reserved;
• Temporarily removed from availability;
• Withdrawn;
• Repriced;
• Subject to an existing application;
• Subject to eligibility requirements; or
• Otherwise unavailable.

The appearance of an apartment on the Website does not constitute a reservation, guarantee, contractual commitment, or binding offer to rent that apartment.

No apartment shall be deemed rented or reserved solely because a user:

• Views an apartment;
• Requests information;
• Schedules an appointment;
• Begins an application;
• Submits an application; or
• Receives preliminary communications from Parkchester.

A tenancy is established only in accordance with applicable law and Parkchester’s required leasing procedures and documentation. Website images of available apartments may vary from actual conditions, including colors and spatial perspectives.
________________________________________
5. RENTAL RATES

Rental rates appearing on the Website are subject to change to the extent permitted by applicable law.

Rates identified as “starting at,” “from,” “as low as,” or similar language represent the starting rental rate for certain apartments or availability and do not represent a guarantee that all apartments of the same size, room number, layout, building, or category will be offered at that rate.

Rental rates may vary based upon factors including:

• Apartment;
• Building;
• Location;
• Floor;
• Layout;
• Size;

• Promotional program;
• Concession;
• Regulatory status; and
• Other lawful considerations.

The rent applicable to a particular tenancy will be reflected in the applicable lease and related documents.
________________________________________
6. PROMOTIONS, CONCESSIONS, AND SPECIAL OFFERS

Parkchester may from time to time advertise rent promotions, rent concessions, free-rent periods, reduced rents, incentives, or other special offers to the extent authorized by applicable law.

Unless expressly stated otherwise, promotions:

• Are subject to availability;
• May apply only to selected apartments;
• May apply only during specified periods;
• May require a specified lease term;
• May not be transferable;
• May not be combined with other offers;
• May expire or be modified; and
• May be subject to additional terms and conditions.

Nothing displayed on the Website requires Parkchester to extend a promotion after it expires or to apply a promotion to an apartment, applicant, renewal, or transaction that does not satisfy the applicable promotional requirements.

Any promotion or rent concession actually applicable to a tenancy must be reflected in the applicable lease, rider, concession agreement, or other written agreement or documentation.

• Building configuration; and
• Other physical characteristics.

Furniture, decorations, artwork, and personal property shown in photographs, renderings, videos, or virtual tours are for illustrative purposes unless expressly stated otherwise.

Dimensions and square-footage information are approximate unless expressly guaranteed in an executed agreement.

Prospective residents should independently inspect the particular apartment offered to them before entering into a lease when an inspection is available.

• Approval;
• Apartment availability;
• A particular apartment;
• A particular rental rate;
• A particular move-in date;
• A concession;
• A lease; or
• Any other particular result.

Applications are subject to Parkchester’s applicable policies, procedures, eligibility requirements, and screening criteria, as well as applicable federal, New York State, and New York City law.

Applicants are responsible for providing complete and accurate information.

Parkchester may request documentation reasonably necessary to process an application in accordance with applicable law.

Submission of false, misleading, fraudulent, or materially incomplete information may result in denial or cancellation of an application to the extent permitted by law.

9. RENTAL ASSISTANCE AND SOURCE OF INCOME

Parkchester complies with applicable federal, New York State, and New York City fair-housing and anti-discrimination laws.

12. MAINTENANCE AND REPAIR REQUESTS

The Website may provide residents with the ability to submit maintenance, repair, heat, plumbing, or other service requests.

Online service requests are offered as a convenience.

Residents should provide accurate information concerning the nature and location of the requested repair.
________________________________________
13. EMERGENCIES

Website forms, emails, and routine electronic service requests should not be relied upon for life-threatening emergencies or circumstances requiring immediate emergency response.

In an emergency requiring police, fire, ambulance, or other emergency services, users should contact 911.

Certain services may be provided through secure third-party platforms, including RentCafe or successor platforms. Parkchester job applications are managed online by ADP, Inc. or its affiliates. Those third-party platforms have their own terms of use and privacy policies that you should also review and will be required to accept.

An attempted payment for rent or other charges does not constitute a completed payment unless and until the payment is successfully processed, received, and credited as applicable.

Residents remain responsible for complying with payment obligations under their lease and applicable law.

Website information concerning a balance, payment, or account should not supersede official Parkchester records where a discrepancy exists.

Residents who believe account information is incorrect should contact Parkchester pursuant to the below Contact Information.
________________________________________
15. THIRD-PARTY PAYMENT AND RESIDENT PORTALS

Third-party payment, application, resident, or service platforms may operate independently from ParkchesterNYC.com.
